He helps companies plan efficient tax structures, and also works with clients to resolve tax controversies. In addition, Mark helps hospitals and physician groups form joint ventures. He served as the firm’s Vice Chairman from 2009-2014.
Mark’s practice focuses on solving the partnership and corporate tax problems of publicly and privately held businesses. Clients rely heavily on Mark’s experience for planning the most efficient tax structure for their financial and M&A transactions. Mark also has substantial experience with tax controversies before federal and state taxing authorities and with the submission of private letter ruling requests for taxpayers.
In the healthcare industry, Mark works with hospitals and physician groups to form joint ventures for diagnostic and therapeutic services.
Mark has worked closely with lawyers in the Employee Benefits Practice Group to evaluate tax issues involved in the structuring of Executive Compensation Plans. Mark also works closely with lawyers in the Corporate and Securities and Trust and Estates Practice Groups with business succession planning.
Mark, along with a team of firm lawyers successfully represented Home Concrete & Supply, LLC before the Fourth Circuit Court of Appeals and the United States Supreme Court (Home Concrete & Supply, et. al v. United States, (April 25, 2012) Case No. 11-139) in a case in which the Supreme Court in a landmark and closely watched case upheld the three-year income tax statute of limitations and ruled that income tax treasury regulations promulgated by the U.S. Treasury were invalid under the principles of Chevron, U.S.A. v. National Resources Defense Council, Inc., 467 U.S. 837 (1984).
In addition, Mark assists clients in acquiring and operating aircraft, including counseling these clients in tax planning related to the acquisition and operating of these aircraft. He also guides clients in aircraft services, flight services and maintenance agreements related to these transactions.

Mark’s clients include NASCAR teams and drivers. He counsels motorsports clients in negotiating sponsor, driver and requirements contracts, as well helping them with aviation (including aircraft purchase), tax, business and operations planning matters.
