Elizabeth O’Neill is a Partner in the Firm’s Charlotte and Atlanta offices. She focuses her practice on defending clients in complex litigation matters involving product liability, toxic torts, and professional responsibility. She has defended and tried cases across the country involving claims related to asbestos, aviation, constitutional torts, legal malpractice, premises liability and product liability.
An experienced trial lawyer, Elizabeth has represented clients in trials in California, Connecticut, Georgia, Maryland, Minnesota, New Jersey, North Carolina, Pennsylvania, South Carolina, Washington, and Wisconsin.
Toxic Tort Litigation Practice
Elizabeth began defending clients in asbestos litigation in 2000 and since that time has defended clients against claims for exposure to asbestos, silica, beryllium and toluene. She acts as local, regional, and national counsel, establishing and implementing defenses from case inception through appeal.
In 2005, Elizabeth obtained a defense verdict in a mesothelioma case in Baltimore City, Maryland. It was the first defense verdict in a mesothelioma case in that jurisdiction in more than ten years and more than two dozen trials.
In 2006, she obtained a defense verdict in Phase I of a reverse bifurcated trial in Philadelphia involving a living mesothelioma plaintiff. In 2009, she obtained a defense verdict in a living mesothelioma case in Minnesota.
Her appellate experience includes obtaining the dismissal of plaintiffs’ asbestos verdicts and an orders for new trial from the Ninth Circuit sitting en banc in 2014 and from the Georgia Supreme Court in 2016.
Elizabeth has also obtained dismissal of claims asserted in Georgia, alleging injury as a result of exposure to beryllium used in the manufacture of military aircraft. Her work included two reviews by the Eleventh Circuit Court of Appeals affirming dismissals on claims asserted against her clients.
Product and Professional Liability Litigation
Elizabeth has represented manufacturers of a wide variety of products, including table saws, camping equipment, lawn care tools, and aviation products, and has tried product liability cases to verdict in Wisconsin and Georgia.
In 2010, she obtained a defense verdict in a Georgia product liability case involving claims of defective design and manufacture. She has handled aviation product liability claims in Georgia, Tennessee, Virginia and Puerto Rico
A regular speaker on topics related to professionalism, Elizabeth defends lawyers, law firms, architects, and other professionals in claims for malpractice or misfeasance. She has successfully represented clients at trial in Georgia, and has been instrumental in obtaining rulings from Georgia Appellate Courts which clarify and strengthen the requirements for imposing liability upon professionals.
Elizabeth has represented law firms and professionals in malpractice cases in Georgia for more than fifteen years. Her experience includes both jury trials and appellate work. Most recently she obtained a favorable ruling in a legal malpractice case from the Georgia Court of Appeals further clarifying the limited circumstances in which a dissatisfied client may sue its lawyer.
