He Did What? Recent Trends in the Case Law Affecting Medical Device Sales Representatives

Claims against medical device sales representatives are on the rise. Recent court decisions indicate that medical device sales representatives pains to ensure that the treating physician or surgeon has received and reviewed all available product literature and warnings before a procedure is performed.
 
Womble Carlyle attorneys Jackie Terry Hughes address this growing concern, and what medical device manufacturers and their sales representatives should know going forward, in a new article. The article, entitled “‘He Did What?’— Recent Trends in the Case Law Affecting Medical Device Sales Representatives” appears in the current issue of Strictly Speaking, a publication of DRI, the Voice of the Defense Bar.

Jackie Terry Hughes
, a member of the Firm’s Product Liability group, has focused much of her career on counseling and defending manufacturing entities on a variety of matters.  Her broad range of litigation experience has extended across the country as well as work in the United Kingdom. Hughes also is well-versed in risk management and due diligence, and advises clients on such issues as warranty terms and conditions, drafting warning language in contracts seeking to limit liability, and assist clients in claims handling and analysis. She practices in the firm’s Raleigh office.

Carrie Hanger represents clients at all stages of litigation, from presuit investigation, pretrial discovery, dispositive motions, and trial preparation through trying cases to a jury verdict and handling appeals. She has defended clients in both federal and state courts. Her experience includes representing companies in a wide range of industries in product liability cases, complex insurance litigation, employment disputes, general tort claims, and trust and estate litigation. Hanger practices in the firm’s Winston-Salem office.
