Womble Carlyle Files Comments at FEC on Behalf of National Advertising Industry Coalition

Womble Carlyle attorney Jim Kahl filed comments with the Federal Election Commission on behalf of the American Association of Advertising Agencies, the American Advertising Federation, and the Association of National Advertisers. The FEC has proposed rules that address the rights of corporations, advocacy groups, and trade associations to fund pre-election ads that refer to a federal candidate. Womble Carlyle's comments urge the FEC to allow advertisers to air legitimate commercial ads in the weeks preceding primary and general elections, even if the ads refer to or mention a federal candidate. This would protect ads for products and services where the business may be owned by a federal candidate, as well as ads for books, movies, and other entertainment. The FEC rulemaking proceeding is in response to the Supreme Court's recent decision in Federal Election Commission v. Wisconsin Right to Life.
