U.S. Sentencing Commission Amends Sentencing Guidelines for Organizations

Last week, the U.S. Sentencing Commission published amendments to the Federal Sentencing Guidelines for organizations. Included in these amendments are two significant changes to the provisions regarding effective compliance and ethics programs. First, the changes allow a corporation to receive a mitigating credit for maintaining a compliance program, even if a senior executive is involved in the offense, provided that certain requirements are met. Second, the amendments clarify the steps a corporation should take to respond to criminal conduct. The amendments become effective November 1, 2010 unless rejected or modified by Congress before then.
