Womble Carlyle's Workplace Solutions Breakfast Series presents two “The Employee Free Choice Act” seminars in early December in the Triad.

When the new Congress takes office in January 2009, they are expected to discuss the Employee Free Choice Act (EFCA), a proposed piece of legislation that could have a tremendous impact on labor-employment relations by making it easier for labor unions to organize workers. The House of Representatives passed the EFCA in 2007, although the Senate did not. However, with new representation coming to Capitol Hill in January, supporters of the bill are expected to make an all-out push to win passage. Some of the key provisions of the legislation include: 

  • Eliminating secret-ballot elections to form unions within a workplace. Instead, unions could organize using a “card check” system, in which a union may be certified if more than 50 percent of a workplace’s employees sign an authorization form or card. 
  • Providing civil fines of up to $20,000 for companies found to have committed violations during an organizing campaign or first contract drive. Currently there are no civil fines for violations. Also, workers who are unlawfully discharged could receive treble damages under the EFCA. 
  • Increasing the role of government arbitrators. Under the EFCA, federal officials may unilaterally impose wage, benefits and other terms of employment if an employer and union do not reach an agreement after 120 days of bargaining for a first contract.
