Carol Brani to Present Mobile Entry Sweepstakes Compliance Webinar

Womble Carlyle attorney Carol Brani will present a Webinar on “5 Tips for Staying off the Compliance Hot Seat While Capitalizing on the Popularity of Mobile Entry Sweepstakes.” The Webinar takes place at 2 p.m. EST on Thursday, Feb. 16th and is presented by the Promotion Marketing Association (PMA).
 
More and more advertisers are engaging with consumers and expanding brand and product awareness by running sweepstakes where consumers enter by texting, Tweeting and “liking”.  Whether businesses invite customers to participate in sweepstakes and contests via Facebook, Twitter, Foursquare or text message, being familiar with the changing legal landscape and disclosure requirements for mobile marketing of promotions, as well as applicable platform guidelines, is key to reducing exposure. In this presentation, Brani will focus on identifying five key compliance issues raised by sweepstakes entered by consumers using mobile devices, and will offer solutions and practice tips for addressing each issue.

Brani’s presentation will address:
  • A brief overview of how the law of sweepstakes and contests applies to mobile marketing
  • What disclosures are required in connection with charges on wireless services bills
  • Complying with platform guidelines in the operation and fulfillment of your mobile promotions
  • Obtaining consent or permission to send consumers text messages and other communications
  • Privacy concerns specific to mobile applications, including location-based services, and how to avoid becoming a target of regulators’ increasing concern about consumer privacy
  • The Mobile Marketing Association’s industry guidelines and recently-issued Mobile Application Privacy Policy Framework
Carol Brani focuses her practiceon advising clients in the areas of advertising and digital promotions, emerging technologies, social media, integration and product placement and in structuring complex licensing transactions for clients in a variety of industries. She prepares and negotiates agency agreements, mobile application and new technology development agreements, event sponsorship and co-promotion and other trademark license agreements, and regularly counsels clients on compliance with laws applicable to sweepstakes, contests, and integrated campaigns. Her experience includes advising clients on advertising clearance, substantiation, gift cards, loyalty programs, celebrity and athlete endorsements, rights of publicity and consumer protection laws.
