James Wilson Moderates “Buying Distressed Debt in Turbulent Times” Discussion

CHARLESTON, S.C.—Womble Carlyle attorney James Wilson participated in a Webinar on “Buying Distressed Debt in Turbulent Times.” The 90-minute program took place on Thursday, Nov. 10th.
This program highlighted the key issues facing buyers of distressed debt and provide insight into current trends, including:
- How to negotiate with debt sellers and what are the key motivating factors for each party;
- How to conduct due diligence of the lender's loan and collateral documentation, and what do you need to do outside of the loan documents.
- What provisions are customarily contained in and negotiated over in the loan sale agreement.
- How to analyze contractual and litigation risks.
- How to close the loan purchase.
Both Wilson and fellow Womble Carlyle attorney Elizabeth Lee have leadership roles in the American Bar Association’s Real Property, Trust & Estate Law Section. Wilson serves as Chair of the Section’s Mortgage Lending Committee, while Lee serves as Vice-Chair of the Section’s Standing Committee on CLE. Dan Orvin also is highly active in the Section and is a regular speaker at ABA programs.
