Matthew Ward to Speak on “Bankruptcy Risks for Second Lienholders”

WILMINGTON, DEL.—Womble Carlyle Bankruptcy attorney Matthew Ward is among the speakers at a Strafford Webinar on “Bankruptcy Risks for Second Lienholders.” The 90-minute Webinar takes place at 1 p.m. on Thursday, Nov. 15th.
Ward and other panelists will analyze risks facing second lienholders in bankruptcy, including lien stripping, standing, Section 363 sales free and clear of liens, intercreditor agreements, and valuation of secured creditor’s collateral. The program will outline best practices for minimizing the risks.

- Can a court authorize a sale of property free and clear of out-of-the-money liens when the junior lienholders do not consent to the sale?
- How does valuation of the secured creditor’s collateral impact the ability of the debtor to strip junior liens?
- What impact will the Heritage Highgate ruling have on the role of creditors’ committees in the reorganization process?
Matthew Ward represents numerous public and private companies as debtors, bidders, purchasers, secured lenders, and creditors in various Chapter 7 and Chapter 11 bankruptcy cases and adversary proceedings, as well as in out-of-court acquisitions of distressed assets, and change of control transactions. Ward also regularly represents official committees of unsecured creditors in bankruptcy cases. He is a member of the American Bankruptcy Institute and the Delaware Bankruptcy Inns of Court.
