Recap-New Terrain of Government Investigations

On March 13 in Tysons Corner, VA, a distinguished panel of attorneys, government officials and business people examined the government's current approach to corporate investigations. The panel focused on the implications of the new "McNulty Memorandum" on the state of the attorney-client privilege and work product protections for private-sector organizations.
Womble Carlyle attorney Frank W. Bullock Jr. who served as a District Judge for the U.S. District Court, Middle District of North Carolina, for 24 years, including seven years as Chief Judge participated as a panelist. While on the bench, Bullock had three significant civil rulings affirmed by the U.S. Supreme Court. He now is a member of Womble Carlyle’s Business Litigation Practice Group, concentrating on dispute resolution case assessment. Bullock also advises clients in a wide range of business litigation and pre-litigation matters, including internal investigations.
The panel included:
o Kyle Sampson has served as Chief of Staff at the U.S. Department of Justice since September 2005. Previously, he was Deputy Chief of Staff to Attorney General Gonzales, Counselor to Attorney General John Ashcroft, and Associate Counsel to the President. He also served as Counsel to Senator Orrin G. Hatch on the Senate Judiciary Committee.
o John Hueston is a litigation partner with Irell & Manella, focusing on trial practice and securities law, corporate crisis management, internal investigations, complex civil litigation, and white-collar criminal defense. Prior to going to Irell, Hueston served on the Enron Task Force and served as lead prosecutor in the case against Jeffrey Skilling and Kenneth Lay of Enron.
o Beth Wilkinson is Fannie Mae's executive vice president - general counsel and corporate secretary, responsible for overseeing and managing all legal issues, strategies, services and resources for the corporation. She serves as the business-oriented, senior legal advisor to the board of directors, chief executive officer, and members of the senior management team. Prior to joining Fannie Mae, she was a partner and co-chair of the White Collar Practice Group for Latham & Watkins LLP. Previously, Wilkinson served as special counsel to deputy U.S. Attorney General and was principal deputy of the Terrorism & Violent Crime Section and a prosecutor on the trial team in U.S. v. McVeigh and Nichols (the Oklahoma City bombing case).
