Recap: Womble Carlyle Hosts Lunch & Learn on Key Bankruptcy Issues

During this lunch and learn program on December 1st, members of Womble Carlyle's Bankruptcy and Creditors' Rights and Capital Markets Groups provided an overview of current trends in bankruptcy law with a focus on equipment leasing / financing issues, and tips on how to proactively position your institution to help yield the best results in the current economic climate. Speakers included Merrick J. Benn, Thomas M. Horan, and Frank A. Monaco, Jr., who shared with attendees practical steps to protect the equipment they finance, including specialty assets involving filings with federal agencies. 
 
Highlights included:
 
  • Pre-bankruptcy actions to have in place;
  • What to be aware of in the initial stages of a Chapter 11bankruptcy case;
  • How to detect disguised sale issues, motion to compel payment issues, and 365 and adequate protection issues;
  • How to avoid "preference" problems under the Bankruptcy Code;
  • What to look for in a typical debtor-in-possession financing order as well as the bidding procedure/sale process;
  • What to do when a lease is assumed or rejected;
  • The role of Unsecured Creditors' Committees;
  • Motions for relief from the automatic stay and other remedies, bar dates, filing proofs of claims, and the plan process; and,
  • Form documentation.
 
The presentation took place at The Center Club in Baltimore, Maryland, and was offered free of charge.
