Breadth of experience, current industry knowledge and a commitment to client service form the core of Womble Carlyle’s Health Care Practice Group. The recent expansion of the practice through the addition of many new and seasoned attorneys devoted exclusively to the health care industry and the Firm’s long history of representing health care clients in regulatory, antitrust, corporate, tax, public finance, employment, employee benefits, intellectual property, real estate, and litigation matters combine to make ours one of the most experienced health care practices in the region.

Although more than 50 of our attorneys routinely work with health care clients, 12 attorneys make up the core of the Firm’s multi-disciplinary health care team in its representation of health care clients, including hospitals and health systems, long term care facilities, home health providers, multi and single specialty physician groups, managed care organizations, independent clinical laboratories, pharmaceutical companies, ambulatory surgery centers and providers of outpatient and ancillary care services. The nature of the Firm’s representation of health care clients is both practical and comprehensive, including:

  • Assistance with strategic, regulatory and transactional aspects of restructuring delivery of care into new models (caused by advancement in health care technology, the shifting of care to outpatient sites, changes in reimbursement and the integration of competitors)
  • Experienced advice to local and national clients on compliance with complex federal and state regulations, including Medicare and Medicaid fraud and abuse questions, physician self-referral provisions (“Stark II” and related laws), civil monetary penalty (“CMP”) issues, Medicare reimbursement questions, licensure, certification and certificate of need matters
  • Representation of clients in conducting internal compliance reviews and legal audits
  • Assistance to clients in the financing of health care services
  • Advice to clients on traditional health care operational issues, such as medical staff matters, EMTALA, Advanced Directives, Joint Commission, compliance, IRB, medical records, risk management, consent, and other clinically related concerns 
  • Litigation on behalf of health care clients before federal and state courts, regulatory agencies and administrative tribunals
  • Representation of traditional health care providers in analyzing HIPAA security and privacy requirements for the electronic maintenance and transfer of health information
  • Provision of legal services to health care providers concerning liability, licensure, reimbursement and other issues with respect to the use of telemedicine technology
  • Advice to e-health businesses with internet based health care services or products on professional licensure issues, state law confidentiality requirements, and informed consent matters
