Independent Cable Prepaid Legal Services Program

FREE WEBINAR: Privacy for Independent Cable – Obligations and opportunities in a rapidly changing framework

Presented by Independent Cable News and Womble Carlyle Sandridge & Rice, PLLC

While all businesses have concerns regarding the private information of customers and employees, the challenges faced by cable operators are compounded by special privacy restrictions imposed not only by the Cable Act, but by cable’s status as an electronic communications service provider and as a telephone provider.

On November 16th, Independent Cable News and Womble Carlyle will present a webinar to identify the relevant privacy laws governing cable and provide practical approaches to comply with the various requirements. Attendees will also learn how the convergence of technological advancements and likely changes to laws early next year will affect independent cable and ways to best prepare.

When the Satellite Television Extension and Localism Act of 2010 (STELA) became law last month, Congress made changes affecting cable compulsory copyright license retroactive to January 1, 2010.

Many of these changes impact copyright filings due in August, some of which may be audited. Audit adjustments for 2010 may be easily applied to prior year filings and will likely result in additional demands for payment, under threat of infringement lawsuits. Join us for this complimentary webinar to ensure your 2010 filings are as clean as possible.

Free admission to a legal update seminar held simultaneously with the Independent Show beginning in 2011.[1]

Why Womble Carlyle:
Womble Carlyle offers a combination of three important elements that are simply not found in any other law firm:

  1. We know your business. Lawyers in our cable practice collectively have more than three-quarters of a century of cumulative experience representing dozens of independent cable operators. In fact, Eric Breisach served as outside legal counsel to the Small Cable Business Association/American Cable Association from shortly after its founding in 1993 through 2000. During that tenure, Congress and the FCC were persuaded to create an entire body of special provisions for smaller and independent cable operators.
  2. We are on your side. Unlike most other law firms that represent cable interests, Womble Carlyle does not represent major programmers. This allows us to take positions unconstrained by political interests of other clients. Thus, we can assist in programming matters from simple affiliation agreement issues to full-blown program access arbitrations.
  3. We offer full array of legal services.  The legal issues facing independent cable operators on a day-to-day basis are not limited to purely communications law related issues. Our legal services go far beyond what communications boutique law firms can offer. Womble Carlyle’s cable lawyers are supported by a full-service law firm that can help with virtually any type of legal matter, whether it be an employment issue, a problem with your local bank, real estate problems, competitive advertising, use of consumer credit scores, privacy, technology purchases, patent, copyright or other intellectual property law challenges or tax issues to name a few. Click here to take a look at the breadth of our practice.
What if a question can’t be answered in 20 minutes? If after having the telephone consultation, more needs to be done, we will talk further about what additional steps need to be taken as well as the cost of taking those steps. Womble Carlyle is a pioneer in the design of alternative fee arrangements, including project pricing where possible. We are acutely aware of cost constraints facing many independent cable operators.

Are there circumstances when a question can’t be answered?
We don’t anticipate it, but yes, you might have a question that falls outside one of our practice areas. Also, if you ask us a question that is adverse to another party, as any law firm is required to do, we will check our client lists to make sure that we don’t already represent the other party in any way. If we do, we might not be able to answer that question. But not to worry, if for some reason we can’t answer a question, the call doesn’t count towards your annual total.

How do I become a client of Womble Carlyle?
Becoming a client is simple. Complete the information page that gives us some information about your company. We will check to make sure that we don’t have any other representations that would limit or preclude our representation of you. We will then send to you and discuss an engagement letter that outlines the details of our relationship. If you find the terms acceptable, sign and return it with a check for $975 and you are then represented by one of the best cable legal teams and firms around!

What if I change my mind?
We don’t think you will, but in the event that you have second thoughts or find that this program does not meet your needs, you can terminate your participation and our representation of you at any time by giving us written notice. The amount that you prepaid will be considered earned during the course of the year and also based on the number of calls that you have made to us. For example, if you haven’t made any calls after two months and you decide to withdraw from the program, we will refund 10/12ths of your prepaid amount ($812.50). These details are all spelled out in the engagement letter.

How to get more information?
