Beth Tyner Jones

Beth practices primarily in the areas of employment and education law. She concentrates her practice on providing effective counseling and compliance assistance to enable her clients to manage risks proactively. Beth uses her experience as a human resources professional and in-house legal counsel to assist employers, both public and private, in complying with all federal and state employment laws including preparing policies, procedures, programs, plans, handbooks, and employment agreements, as well as providing training for employers on a variety of employment practices. In addition to her experience with corporate employment issues, Beth has a significant background in representing not-for-profits, including private elementary and secondary schools, charter school management companies, and institutions of higher learning. In particular, she assists in faculty, administrative and staff employment issues unique to the academic world and has served as a faculty member before rejoining Womble Carlyle. Some of Beth’s recent representative engagements include:
 
  • Reviewed and prepared numerous policies, handbooks, and codes of conduct for a variety of employers including those with multi-state workforces as well as college faculty and staff handbooks;
  • Counseled employers in a wide variety of difficult employment terminations, hires, reassignments and leaves involving employees with medical issues, retaliation claims, poor performance, discrimination claims, and tenure disputes;
  • Designed and delivered interactive training programs for non-harassment, investigations, effective evaluations and ADA/FMLA compliance. Programs developed include those aimed at supervisors and managers, human resources professionals, and the entire workforce;
  • Developed workforce restructuring programs including selection processes, voluntary and involuntary severance programs, and early retirement options. Prepared releases and advised on WARN and OWBPA issues in rollout of restructuring programs;
  • Prepared severance plans and phased retirement agreements. Assisted in benefits plan administration issues;
  • Counseled colleges, large not-for-profits, and major companies in FLSA-compliance and audits;
  • Provided advice on I-9 compliance and human resources issues involving expatriates and employee relocation domestically and internationally;
  • Prepared employment agreements including those for top executives and administrators;
  • Advised colleges on ADA and Rehabilitation Act compliance for faculty, staff and students;
  • Developed affiliation and internship agreements for colleges;
  • Represented employers before administrative agencies such as the EEOC and OCR on administrative charges by employees and students in mediation and in litigation;
  • Provided advice and assisted in policy development regarding privacy concerns primarily involving employee data.
