John’s practice focuses on intellectual property and complex commercial and antitrust litigation. John has led all aspects of patent infringement, trademark infringement, unfair competition, copyright infringement, trade secret misappropriation, false advertising, and antitrust lawsuits, and has served as first and second chair in state or federal courts sitting in North Carolina, Nevada, Wyoming, Pennsylvania, Delaware, Massachusetts, Ohio, New York, New Jersey, Connecticut, Georgia, South Carolina, Utah, and Virginia.
John is admitted to all state and federal courts in North Carolina, as well as to the Federal Circuit Court of Appeals (where he has argued multiple times), the Fourth Circuit Court of Appeals, the Sixth Circuit Court of Appeals, and The United States Supreme Court. In 2009, John was one of two North Carolina attorneys under 40 years of age voted to North Carolina Super Lawyers’ “Rising Stars” for intellectual property litigation. In 2011 John was voted by Business North Carolina Magazine to the 2011 North Carolina Legal Elite for intellectual property law, and in 2012 John was named one of the world’s leading trademark professionals in World Trademark Review. John has also received Martindale Hubbell’s highest peer review rating (“AV”) for ten years running.
John has litigated patent disputes involving computer sweepstakes software, transit peptides, catalytic converters, dye tubes, firearms, furniture designs, and various other mechanical and electrical engineering technologies. John’s copyright litigation experience includes disputes involving computer software, video games, wild game mannequins, children’s books, clothing designs, photography, musical compilations, and architecture. John’s trademark and unfair competition experience includes disputes involving furniture designs, NASCAR numbers, ammunition packaging, and various product names and packaging. John’s antitrust litigation experience includes recently winning summary judgment for a hospital in defense of a thirteen count antitrust complaint in which a physician sought more than $100,000,000 in trebled damages.
