John G. Perry

John Perry is a senior associate in Womble Carlyle’s Atlanta office where he concentrates his practice in the area of complex business litigation. John has successfully defended officers and directors of publically traded companies against claims of federal and state securities fraud and breaches of fiduciary duty. John has successfully represented major financial institutions involving complex issues regarding Articles Three and Four of the Uniform Commercial Code, consumer privacy issues, TILA, FCRA, and other consumer protection statutes. 
 
John has litigated several complex business asset and stock purchase agreements, fraud, other business torts cases, and cases involving contract disputes, restrictive covenants (non-competition, non-solicitation, and non-piracy agreements), employment agreements, and complex sale of goods contracts under Article Two of the Uniform Commercial Code. John has also handled several cases successfully in the Georgia Court of Appeals and the Eleventh Circuit Court of Appeals. He had also litigated several complex commercial arbitrations in front of single and three arbitrator panels under the AAA rules.

  • Awarded summary judgment in defense of former chief financial officer of a publically traded company on state securities fraud claims.
  • Successfully defended outside director of a publically traded telecommunications company in a class action complaint for securities fraud on a motion to dismiss filed in the Southern District of Florida.
  • Awarded summary judgment in defense of major petroleum company for property damage claims related to historic fertilizer manufacturing plant operations.
  • Successfully defended financial institutions in cases involving third party employees who embezzled significant funds through forgeries.
  • Awarded summary judgment on fraud claims related to an asset purchase agreement in an acquisition by a publically traded technology company.
  • Successfully defended pharmaceutical benefit manager (PBM) in a multi-million dollar arbitration for breach of contract.
