John A. Thomson, Jr.

John Thomson focuses on the representation of financial institutions, commercial trade creditors, life insurance companies, private equity investors and subordinated debt holders in bankruptcy, pre-bankruptcy restructuring transactions and commercial litigation.
Mr. Thomson has represented financial institutions in all facets of commercial bankruptcies, including cash collateral issues, stay related proceedings, debtor-in-possession financing, sales of assets from the bankruptcy estate, contested confirmation issues, and adversary proceedings arising out of avoidance claims. In addition to his creditor representation, John was debtor’s counsel in the Chapter 11 reorganizations of Peachtree Natural Gas, LLC , American Plastic Surgery, LLC and Gulf Coast Restaurants, Inc . In addition, Mr. Thomson served as counsel to the Committee of Unsecured Creditors in the Currahee Club bankruptcies.
Mr. Thomson also has transactional experience in restructuring defaults on a wide variety of asset-based loans, real estate loans, syndicated debt and assets subject to indentures. Mr. Thomson has particular experience in resolving defaults arising out of resort, golf and vacation developments.
Mr. Thomson’s representation of financial institutions has given him significant experience in federal and state court litigation involving creditors’ rights issues, regulations affecting financial institutions, the defense of class action and multi-district litigation regarding alleged violations of the Truth-in-Lending Act, the Real Estate Settlement Procedures Act, predatory lending statutes, commercial paper and depository items under the UCC, and commercial lender liability actions.
John and his wife, Jane, have two children, Jack and Mary Catherine.
