Kurt Weaver is an experienced and aggressive trial lawyer whose practice includes complex commercial, toxic and mass tort, and products liability litigation matters. Throughout his nearly twenty years of practice, Kurt has successfully handled trials, arbitrations, and mediations for businesses ranging in size from Fortune 100 companies to local nonprofit concerns.
In addition to his first chair trial experience, Kurt’s litigation background encompasses hard-fought discovery battles, high profile motion practice in hostile venues, and expert witness challenges on Daubert and Frye issues. As a seasoned litigator, Kurt continually redefines the discovery process, developing new and innovative approaches. Kurt Weaver was honored as a 2011 Leader in the Law, awarded by North Carolina Lawyers Weekly.
Recent matters typical of his experience include:
- Obtaining a $24 million sanctions award against Kansas City’s largest hospital system for discovery misconduct in the largest case ever tried in the Circuit Court for the City of St. Louis, Missouri;
- Obtaining a complete defense verdict for R.J. Reynolds Tobacco Company in a business tort case brought by 37 Missouri hospitals claiming $477 million in unreimbursed healthcare costs plus punitive damages;
- Defending businesses and entities against allegations of fraud, conspiracy, breach of warranty, and negligence in consumer product cases;
- Defending consumer product manufacturer against claims of conspiracy, collusion, price fixing, and bribery in antitrust litigation;
- Defending R.J. Reynolds Tobacco Company in various types of personal injury litigation and cases seeking to recover health care costs filed by hospitals, cities, and other product manufacturers. See, e.g., Owens Corning v. R.J. Reynolds Tobacco Co., 868 So.2d 331 (Miss. 2004); and
- Defending Wal-Mart Stores, Inc. in litigation seeking statewide class action status for 180,000 plaintiffs and on appeal affirming trial court’s denial of class action status. Harrison, et al. v. Wal-Mart Stores, Inc., et al., 613 S.E.2d 322 (N.C. Ct. App. 2005)
