Michael is a member of the Firm’s environmental and toxic torts practice group, but also enjoys a broad litigation practice in areas of business litigation, products liability, personal injury, legal and medical malpractice defense and both commercial and residential landlord-tenant and collection work. While most of his work is defense oriented, he has represented a number of plaintiffs in business disputes and other matters. He has represented clients in both state and federal courts across the State of South Carolina, arbitrations in South and North Carolina, as well as in negotiations with the South Carolina Department of Health and Environmental Control (DHEC) and the United States Environmental Protection Agency (EPA).
His environmental and toxic tort experience has spanned a number of litigation and regulatory matters, including:
- Defending a national power company in litigation alleging exposure to toxic and hazardous substances.
- Defending an officer of a local business in an action brought by a neighboring property owner alleging individual liability under CERCLA and RCRA related to the alleged disposal and subsequent migration of hazardous substances.
- Representing a national power company in litigation with private parties and negotiations with EPA related to a Superfund Site in North Carolina.
- Representing a number of local businesses in negotiations with and enforcement actions brought by DHEC regarding stormwater, water quality certification and other state permitting issues.
- Assisting lenders and other clients in navigating the due diligence requirements of CERCLA, and ensuring adequate security for loans when working with high risk properties.
- Secured necessary state and local permits for a multi-million dollar expansion of an Upstate quarry for an international mining corporation.
Michael has gained valuable experience in trying several cases and arbitrations to verdict, briefing and arguing many dispositive motions and appeals, and mediating numerous other matters in an effort to efficiently resolve cases before they reach court. Among his litigation matters:
- Representing a national construction firm in a personal injury lawsuit through trial.
- Representing a national lender in a number of alleged mortgage fraud lawsuits, taking the lead role in both arbitration proceedings and a trial.
- Representing a real estate developer in a business dispute with its general contractor, involving allegations of fraud and unfair trade practices.
- Representing a number of corporate defendants in personal injury cases, contract disputes and a variety of other litigation matters.
- Representing a South Carolina attorney in a legal malpractice action, prevailing at summary judgment and on appeal, resulting in a published South Carolina Court of Appeals decision focusing on the applicable statute of limitations and the discovery rule.
- Representing a South Carolina physician in a hospital disciplinary proceeding, successfully challenging the recommendations of the hospital at a fair hearing.
