Todd has a national practice focused on employee departures and defections, including the litigation of injunctions and damages cases involving noncompete and nonsolicitation covenants, trade secret misappropriation, unfair competition allegations, duty of loyalty breaches, inevitable disclosure, employee raiding, and federal intellectual property and criminal laws including the Economic Espionage Act of Computer Fraud & Abuse Act.
Todd has litigated over 100 employee defection matters in numerous federal and state courts and has served as lead counsel in the arbitration of many more. His clients in these matters span every industry sector – banking, insurance, biotechnology, manufacturing, life sciences, computer services, computer software, personnel placement, securities brokerage, advertising, radio and television broadcasting, legal, medical and architectural professional services, government contracting, and even NASCAR. In recent years, Todd has served as lead defense counsel in one of the most significant broker defection cases ever tried before NASD/FINRA and also as lead plaintiff’s counsel in the largest-ever reported trade secrets theft case in North Carolina.
In addition to his litigation practice, Todd routinely drafts and assists others in his firm in drafting employment agreements containing restrictive covenants and works closely with clients in identifying and protecting competitively valuable assets and resources. Todd is frequently a go-to resource for Womble Carlyle’s Corporate & Securities and Intellectual Property attorneys in identifying and protecting client assets in these areas, as well. He also represents companies and key employees in negotiating and executing every type of employment agreement, including severance agreements.
Todd is a trusted authority on various legal issues involving employer/employee disputes and is a frequent lecturer on these topics, including recent presentations for the American Intellectual Property Law Institute and the North Carolina/South Carolina Bar Associations’ Annual Labor and Employment Law Conference. He has been repeatedly elected by his peers as a North Carolina Super Lawyer and a member of the North Carolina Legal Elite.
