Phil’s areas of experience include defective product actions, complex contract actions, and commercial tort actions—including unfair and deceptive trade practices, fraud, and misappropriation of trade secrets—where the alleged damages range from loss of profits to loss of life. Phil has recognized that, for numerous reasons, it is not always in his client’s best interest to incur the expense and uncertainty of trial.   • Manufacturer of a cutting-edge medical device used to treat prostate cancer in an action by its national distributor alleging defective product, breach of distribution agreement and unfair and deceptive trade practices. AAA arbitrator awarded less than 5% of distributor’s multi-million dollar demand.
  • Generic pharmaceutical manufacturer in an action by purchaser alleging breach of supply agreement, fraud, and unfair and deceptive trade practices over allegedly defective product, resulting in loss business claim in excess of $10 million. Matter resolved at pre-lawsuit mediation for less than 2% of original demand.
  • Regional hospital and affiliated medical center in lawsuit brought by physician who asserted anti-trust claims and various state tort claims arising from his loss of staff privileges.
  • Fortune 1000 U.S. wood and wood-alternative manufacturer in an action by purchaser over alleged breach of multiple supplier agreements, both express and implied, resulting in alleged multi-million dollar loss of business claim. Matter resolved at mediation for less than 10% of original demand.
  • Fortune 500 pharmaceutical company in numerous actions alleging defective product design, manufacturing, and false advertisement which allegedly led to personal injury, including death. Actions resolved pre-trial for pennies on the dollar.
  • Fortune 500 home manufacturer in numerous actions alleging breach of contract, negligent misrepresentation, fraud and unfair and deceptive trade practices. Matters resolved by nuisance payments at mediation or through minimal jury verdicts.
  • Leading professional stock car racing team in action against former employee for misappropriation of trade secrets, fraud and conversion. Obtained permanent injunction against employee.

Phil’s business litigation practice has also included representing clients in adversarial proceedings in federal bankruptcy matters throughout the country. Phil has represented trustees, creditors’ committees, creditors, suppliers and asset purchasers in preference actions and fraudulent transfer actions under §548 of the Bankruptcy Code.
