Wilmington

Womble Carlyle opened its Wilmington office in 2006 to expand the firm’s Intellectual Property Litigation and Bankruptcy capabilities on behalf of clients.

At that time, a team of Wilmington-based Intellectual Property Litigation attorneys, led by George Pazuniak and Gerard O’Rourke, joined the firm. Pazuniak and O’Rourke bring a combined four decades of experience in intellectual property litigation, counseling, and patent prosecution, all in Delaware.

In 2007, the Delaware office expanded to welcome three experienced bankruptcy attorneys—Steve Kortanek, Kevin Mangan and Frank Monaco. Delaware is a leading national venue for large Chapter 11 cases and related litigation, so having an office in Wilmington gives clients a strategic advantage in this field.

Our services include:
Intellectual Property Litigation—Defending intellectual property is critical in today’s highly competitive business climate. The Wilmington-based Intellectual Property Litigation team has aggressively and successfully represented clients’ IP interests in a wide range of licensing and patent disputes. Many of these matters have been tried before a jury, obtaining verdicts of patent invalidity, unenforceability and non-infringement.

The Intellectual Property Litigation Team has practiced in federal courts all the way up to the United States Supreme Court. Clients in this field represent a diverse range of businesses, including pharmaceutical, biotechnology, chemical, electronics, software and construction products companies.

Bankruptcy—The Wilmington Bankruptcy Team, working in conjunction with the firm’s bankruptcy attorneys in other offices, give clients a deep and talented group, with the bench strength and resources to represent even the largest Chapter 11 matters. Kortanek, Mangan and Monaco are well-known to the Delaware bankruptcy bench, as well as bar members, government officials and business leaders in the state. They provide Womble Carlyle clients with a “home court advantage” in any Delaware-based bankruptcy proceeding.

The Wilmington Bankruptcy Team has litigated:

  • Contested Chapter 11 confirmation proceedings
  • Lender liability claims, preferences and fraudulent transfers cases
  • Non-dischargeability actions
  • Debtor-in-possession financing disputes
  • Valuation cases and
  • Section 105 injunctions.

The team also assists clients with buying assets in Chapter 11 bankruptcy. Many of the opportunities to buy bankruptcy assets are found in Delaware because of its heavy volume of Chapter 11 cases.
