Allen Gibson Contributes to book on Construction Damages and Remedies

CHARLESTON, S.C.—Womble Carlyle attorney Allen Gibson is a contributing author to the new book, Construction Damages and Remedies (second edition). Gibson authored the chapter on “Contractor and Subcontractor Remedies for Breach” and co-authored the chapter on “Design Professional Liability to Clients.”
The “Contractor and Subcontractor Remedies for Breach” chapter includes information on:
- Implied warranty of plans and specifications
- Unforeseen site conditions
- Delay and acceleration
- Failure to make payments
- Changes within the scope of the contract
- Changes beyond the scope of the contract
- Wrongful termination
- Impossibility or Impracticality.
The “Design Professional Liability to Clients chapter,” which Gibson co-authored with A. Holt Gwyn, includes information on:
- Liability for cost estimates (both the loss of the design professional’s fee and other damages)
- Costs of correcting defective design
- Liability for errors, omissions or delays during contract administration.
