Tom Sawyer Contributes Virginia Chapter to New Employment Law Guide

TYSONS CORNER, VA.—Womble Carlyle Labor and Employment attorney Thomas J. Sawyer has written the Virginia chapter of a new national book titled Employment at Will: A State-By State Guide.
The book provides a detailed, state-by-state analysis of causes of action for wrongful termination. The guide was prepared by the Employment at Will Subcommittee of the Employment Rights and Responsibilities Committee of the ABA Section of Labor and Employment Law, and is being published by Bloomberg BNA. Employment at Will: A State-By-State Guide addresses the same topics for each state, allowing for easy state-to-state comparisons.
Of particular interest to Virginia attorneys, Sawyer discusses the public policy tort exception (Section IV) to the state’s employment at will law. Part of that discussion includes analysis of the Virginia General Assembly’s response to Virginia Supreme Court’s decision in the Lockhart case. In their response to the court, lawmakers amended the Virginia Human Rights Act to provide for an exclusive statutory remedy – in other words, there can be no common law-based wrongful discharge based on the public policy underlying the VHRA.
