Environmental Regulatory Experience
Womble Carlyle's team of environmental attorneys regularly advise clients on the applicability and impact of the numerous federal and state environmental statutes and regulations confronting industry.
Members of the group have significant experience working with clients to understand their business and to identify and develop strategies to resolve environmental issues in such a manner as to reduce risk and costs of compliance while maintaining flexibility in the operation of the business. Womble Carlyle’s environmental attorneys regularly work with other practice groups on real estate and business transactions to identify and evaluate environmental issues and to assist with the preparation of indemnification and contractual language to protect our clients.
We have advised clients on applicability, permitting and compliance issues involving all of the major federal environmental laws including Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), Clean Water Act (CWA), Clean Air Act (CAA), Toxic Substances Control Act (TSCA), Resource Conservation and Recovery Act (RCRA), National Environmental Policy Act (NEPA), Endangered Species Act, Federal Insecticide, Fungicide and Rodenticide Act (FIFRA). Additionally, Womble Carlyle has significant experience with unique state laws.
Womble Carlyle has extensive CERCLA, RCRA and state regulatory remediation experience which we have utilized to develop creative cost-effective approaches and Brownfield redevelopment opportunities for our clients. We also have experience with issues regarding climate change risks and regulation, creation of mitigation banks, handling challenges to FEMA flood map designations, wetland banking, permitting and jurisdictional determinations.
Our attorney’s working with and against the EPA and state agencies, and can provide unique insight into the current and future governmental regulatory initiatives and rulemakings. Coordinating with Womble Carlyle's Federal and State Government Affairs Group, our members have sought resolution of client issues directly from lawmakers and congress of state legislators.
