Womble Carlyle’s attorneys are committed to helping clients avoid disputes relating to government contracting. Toward that end, we are regularly called upon by clients to review and draft contract language and to provide risk assessments. In addition, because effective internal controls are essential to avoiding disputes with government customers, our attorneys frequently help clients establish and maintain internal compliance programs, conduct compliance audits, and provide in-house training with respect to business ethics, conflicts of interest, procurement integrity, workplace requirements, and civil and criminal fraud issues. When disputes cannot be avoided, our clients turn to us to represent them with respect to claims, whether brought against the Government or by the Government against the contractor. Moreover, our attorneys are experienced with the use of mediation techniques to resolve disputes, or to keep them from escalating.
Representative experience includes:
- Settling multiple claims before the Armed Services Board of Contract Appeals on behalf of developer of Section 801 military housing
- Advising multiple clients concerning disputed rights under software licenses
- Representing a defense contractor in proceedings related to termination for default, and successful conversion to termination for convenience
- Representing technology contractor in successful resolution of grand jury investigation of alleged false claims and kickback allegations
- Representing defense contractor in successful resolution of inspector general investigation of false claims allegations
- Representing client in mediation proceedings with government agency
- Assisting various clients with respect to claims arising under their government contracts
