Government Contracts
Performance
Government contracting presents unique issues of contract interpretation, and we regularly assist clients in understanding and meeting their obligations under government contracts. We are experienced with the full range of contract performance issues, including cost and pricing, performance evaluations, scheduling and delivery requirements, intellectual property and data rights, socio-economic requirements, Buy America and Trade Agreements Act, and small, disadvantaged, and veterans’ preferences.
Representative examples of our work include:
- Negotiating modification to contract to permit client’s acquisition of rights to software developed under contract
- Counseling numerous clients concerning Buy America restrictions
- Advising several clients concerning novation and other issues arising when acquiring, or being acquired by, other companies
- Advising clients with respect to small and other preference program eligibility requirements
- Advising banks and financial services providers concerning federal contract compliance issues
- Preparing internal business ethics and government contract compliance programs
- Advising clients concerning government-furnished property
